'; div.innerHTML = summary; } //]]> The Importance of Negotiation Training - Secret Business Tip - Defer The Importance of Negotiation Training - Secret Business Tip - DeferAs you may know, negotiating isn't for everyone. Many in business realize this fact but others don't. Those of us with a technical or artistic background may not make the best negotiators. This is unfortunate for those in the early part of their careers. It is during this time when you are your own best advocate so you will have to do your own negotiating. You don't have much experience and likely no formal training. Doubtless, your counterpart has much of both.
When you enter into a negotiating session, take a moment to evaluate the situation. Who is your counterpart? Much older and more successful than you? If so, you really should be prepared before your negotiating session. If you aren't ready, often the best tactic is to defer. This is especially true if you are caught off guard.
Say your boss calls you into his office and tells you to close the door. "Let's discuss your salary review now", he says. You thought that your annual review would be next month so you didn't really do any planning for this conversation. What do you do? You certainly want to hear what your boss has to say. Let him go first. Evaluate why he wants to discuss the matter early. Hopefully he just wants to reward you early because you are such a valued employee. Maybe he wants you to keep working hard now. Maybe there isn't any money for raises and the policy has just been given to your boss. Find out. By carefully listening, you may get some great information. Not just about your current salary, but the company in general.
You may be put on the spot in an unplanned negotiation. "What do you think would be fair at a difficult economic time like this?", you may be asked. How can you answer? Fair might be no raise at all. Maybe a pay cut. Maybe free overtime. There are possibly lots of options. The real answer is that the fair option now is the same as it always is - what's in it for you? That's it.
When you really aren't prepared to negotiate and you get put on the spot, you need to defer the session. Ask yourself what's in it for you. Maybe you just got offered improvements that work. If so, count yourself lucky and do the deal. If you didn't, you need to stop the session and start again when you are ready. "Well", you can say, "I thought we would discuss my salary increase next month". This is a strong response. He may have just said that there is no money, times are bad, people are being let go, they have to buy water with only one hydrogen atom now, whatever. "I would like to review what you said and look at my options". This would be a good time to reschedule. "Can we finish this tomorrow morning?" You need time to prepare but you want to get something finished.
With your position stated, you think you deserve a raise and you want to finish the negotiation the next day, (or as soon as possible), you can maintain a strong position. Now you can wait and listen, again, to what the response is. This gives you a chance to evaluate your counterpart again. If he persists, trying to get you to commit to a number, ask yourself why. Ask yourself, again, what's in it for you. At this point, it likely isn't good. Get out.
By deferring a surprise negotiating session to a time when you are better prepared, you can often be much more comfortable with the process. If you are comfortable, you will have a better negotiating experience. Each time you go through the process, the experience helps you get ready for the next one. Each negotiating session will be similar, in some respects to others that you have had. Listening to your counterpart and deferring to a better time will help you to increase "what's in it for you", and that is always the point to negotiating.

Taxes and Real Estate in Kenya : Economic Impact and Proposed ...
Over the past few weeks we have had a look at the Taxation Regime in Kenya and its relation to Real Estate Development.
This is the last deposit of the 6-Part- Series. We trust our readers have gained a deeper insight on the ensuing issues. The First Part of the Series can be read HERE.
Economic Impact of Taxes on Real Estate
From a reality point of view, taxes reduce the income of individuals and businesses. Lower income affects the allocation of productive resources in subsequent investment cycles, it affects consumer buying patterns and general productivity and growth of the economy.
Resource Allocation
When a tax is levied on a good or service, the cost of production rises, which shifts the supply curve to the left. The decrease in supply, if demand remains unchanged, raises the price of the product.
Real Estate is a product and the apparent high cost of it makes persons react to the higher price by buying less of the product.
This shift defeats the government policy of giving Kenyans affordable housing.
Behavior Adjustment
When there is less demand for Real Estate due to high taxes, some industry directly linked to the Construction sector cut back on production due to a fall in sales. Some workers may lose jobs.
Productive resources- land, capital, labour, and entrepreneurship- are allocated to another industry, or go unused.
This grossly explains the high levels of persons holding onto under-developed Land Resources.
A very high tax regime is counter-productive since the high taxes work like a SIN TAX. It become sort of sin or evil to develop land and persons tend to abhor the act altogether if they don?t feel that charitable.
Productivity & Growth
If persons think taxes are too high, it can hinder productivity and economic growth since a greater portion of their returns on investment goes towards defraying the taxation burden. Why? They argue, should a person seek to earn additional income if much of it would be paid in taxes?
WORKED EXAMPLE (for an Kshs.100m Project)
PRACTICAL SOLUTIONS FOR LAND OWNERS/ GOVT/ DEVELOPERS
a)?Partnership- Land Owners can partner with real estate developers for package deals where the costs and benefits are shared. Think of Joint Venture arrangements, Design-Build-Operate-Transfer. This would greatly lower costs and provide a pseudo cushion for the developer.
b)?Optimize?Tax Efficiencies: When structuring Real Estate Projects, the best practice is to optimize the project as to take advantage of the tax regime. To make Kenya more attractive to Private Equity Investors and other entities wishing to invest in Real Estate, the Government can explore the advantage of using Tax Treaties. Mauritius and South Africa are at the forefront of exploring this advantage where certain taxes are ?switched off? to boost Investment.
c)?Revise Taxation ? To spur economic activity, the government can lower taxation on direct inputs e.g. Cement, VAT etc
d)?Lobbying -Players in the industry can lobby and dialogue with the government to reduce the taxes.
Lobbying can also be done through recognized forums like?the Kenya Alliance of Residents Associations.
e)?Withholding of Payments- Associations like Nairobi Residents Association are of the opinion that where the City Council provides no services, no rates should be paid.

Velti Mobile Ad Report: Israel Sees Highest App Engagement, eCPMs Are Climbing
Velti has just released its mobile ad industry report for June. As usual, the mobile marketing company has chosen to highlight disparate factoids that it culled from the data ? for example, it says that Israel is the leader in app engagement, with adults using apps for an average of 80 minutes per day. Sweden and Singapore are next on the list, while the United States is way behind, with only 38 minutes spent in apps on average. The report also looks at trends in eCPMs, i.e., the amount paid by advertisers for every thousand impressions. There's a lot of talk about how those numbers are lower on mobile, but at least Velti says that for the most part, eCPMs increased from May to June. In sports, average eCPMs increased 23 percent (to 76 cents), and in games they increased 20 percent (to 90 cents). Some Options for Reducing Your Tax Debt with the IRS
So you owe a lot of taxes? Groan! That's not a very happy condition, and it's probably stressful for you?but it's not the end of the world. There are several things you can do to ease the pain. Here are some possibilities you should know about.
1. ?YOU COULD MAKE AN INSTALLMENT AGREEMENT WITH THE IRS
If you don't have all the money to pay off your tax bill all at once, you can set up a monthly payment plan with the IRS. There are four types of agreements.
a) ?Guaranteed Installment Agreements
The IRS is required to agree to an installment plan if your balance due is $10,000 or less,all your tax returns have been filed, and you agree to file your tax returns on time in the future.
b) ?Streamlined Installment Agreements
You can qualify for a streamlined installment agreement if the balance you owe the IRS is $50,000 or less and you pay off the balance in 72 months or less.
c) ?Partial Payment Installment Agreements
If your income cannot handle the minimum payments for either the guaranteed or streamlined agreements,you might qualify fora partial payment agreement in which the monthly payment is based on what you can afford.It can be set up to cover a longer repayment term and the IRS will probably file a federal tax lien to protect its interests. The IRS will re-evaluate the terms of this agreement every two years to see if you might be able to pay more.
d) ?Non-Streamlined Payment Agreement
If your balance due is over $25,000, or you need a repayment term longer than five years, or you don't meet any of the criteria for a streamlined or guaranteed installment plan, you can set up your own terms for with the IRS, but approval is not guaranteed.
2. ?YOU COULD MAKE AN OFFER IN COMPROMISE TO THE IRS
Sometimes the IRS will accept less than full payment (including penalties and interest) if there is doubt as to whether it will ever be possible for you to pay the full amount or if there is doubt as to whether you are actually liable for the full amount.
You must prove that the amount you are offering meets the standards set by the government as to the "Reasonable Collection Potential." It is basically the liquidation value of your assets, such as cars, real estate, and personal property, plus your monthly disposable income over a period of four or five years.
3. ?YOUR DEBT COULD BE DECLARED CURRENTLY NOT COLLECTIBLE BY THE IRS
In extreme cases the IRS can declare a taxpayer's bill as "currently not collectible"and agrees not to collect on the tax debt for a year or so.The collectability status will be continually re-evaluated.
4. ?BANKRUPTCY
Income tax debts may be eligible for discharge under Chapter 7 or Chapter 13 of the Bankruptcy Code. There are strict criteria you must meet to have your taxes discharged.
5. ?PENALTY ABATEMENT
Penalty abatement can be right for you if you can pay the tax liability owed, but believe you should not be held liable for the penalties incurred. This program allows you to pay your tax bill without penalty or interest.
